Costume Rental Agreement

Return Date-The client shall return the costume on the agreed return date.

 

Late Return Policy- As delay in the return of the costume is detrimental to the business of Penguin Point Costumes, a daily penalty shall accrue from the return date until the costume is returned to Penguin Point Costumes.

 

Condition of the Costume Upon Return- Client is not required to wash the costume. However, the client agrees to return the costume in good condition, absent any damaging stains, soil, tears, or other similar damage to the material, otherwise, the client shall be charged of all handling costs. Similarly, the complete set of the costume must be returned. client shall shoulder the cost of any missing items equivalent to the full value of such.

 

Rented “As Is”-Client agrees that the costume is rented on an “As Is” basis.

 

Costume Alterations-Any alteration to the costume is prohibited. Alterations includes dyeing, cutting, distressing, or any similar alterations. No glue of any kind can be used on the costumes. The client will be liable to pay the amount equivalent to the full value of the costume altered. Client may request alterations be made as part of the rental contract, or may make alterations if written approval from Penguin Point Costumes is procured. In such case, the altered costume must be restored to its original condition upon return. If a repair or alteration needs to be made after you procure the costume, contact us before said repair or alteration is complete for approval.

 

Other Obligations of the Client-The client is prohibited from lending the costume to a third party. The costume must remain in the premises of the client. The costume shall be kept in a dry, safe, and secure location at all times.

 

Presumption of Fault-The client assumes responsibility for the loss and/or damage of the costume even when such is caused by fire, flood, earthquake, theft, among other similar causes. The loss and/or damage of the costume in the possession of the client shall be presumed that such loss and/or damage was due to the fault of the client in accordance with the law. Consequently, the client shall pay Penguin Point Costumes the amount equivalent to the full value of the costume.

 

Shipping Option- Client agrees to pay all shipping charges. Costumes must be shipped back out on date agreed upon. Late returns will incur late charges.

Rental Fees-All rental fees and deposits must be paid for before the costume leaves the store. All rentals require a minimum $50 security deposit. The standard security deposit is to be charged with the rental fee and will be credited back to credit card when the rental is returned complete (all items returned in same condition as rented out).

 

Cancellation of Rental-After the costume was fitted and properly endorsed to the client, there will be NO refunds, exchanges, or store credits given for early return on rented item(s). However, if client decides to cancel the rental for an acceptable reason, Penguin Point Costumes shall return the amount equivalent to 50% of the rental fee paid upon the return of the costume.

 

Rental Agreement Updates-Client is aware that periodic updates to this agreement may occur, and all clients are held to the terms of the most recent update.
